The NDIS 90-day claim window: what is law, and what is not yet
Two numbers are in circulation and only one of them binds today. The window for claiming a delivered support is 730 days. A 90-day window starting 1 December 2026 is proposed in a Bill that had not received Royal Assent when this page was last checked.
What is in force today
730 days from the date the support was delivered. That amendment took effect on 3 October 2024 and has been enforced since 3 October 2025. It is the rule a claim is assessed against right now.
What the Bill proposes
90 days from the date of delivery, for supports claimed on or after 1 December 2026. It sits in the Securing the NDIS for Future Generations Bill, introduced on 14 May 2026.
A Bill is not law until Royal Assent. Until then the 730-day rule is what a payment is measured against, and the 90-day figure is what to plan for rather than what to comply with.
The arithmetic, worked
Take a support delivered on 1 September 2026. Its 90-day boundary is 30 November 2026. Under the 730-day rule in force, the same support stays claimable until 31 August 2028.
The window counts days, not calendar months: ninety days from 1 September 2026 lands on 30 November 2026, not the first of the month after. Two years means 730 days, not two calendar years.
Who this reaches
Any pipeline where the claim is not raised close to the shift. Monthly batching, invoices chased after the fact, and plan managers waiting on provider paperwork all consume the same 90 days.
What to do now
- Claim weekly rather than monthly, so a delay costs days instead of a cycle.
- Triage aged claims: anything already past 90 days from delivery is what would stop being claimable first.
- Fix the slowest step, which is usually the paperwork a claim waits on rather than the submission itself.
